Report released regarding man struck and killed by CBRPS vehicle
The province's independent Serious Incident Response Team (SiRT) today released its report regarding a collision between a Cape Breton Regional Police Service (CBRPS) vehicle and a 66-year-old man which occurred on the afternoon of April 4, 2015.
On that date, the man who was later struck, had been helping a young boy who had fallen out of a second story window in a neighbouring house. The boy suffered what appeared to be a serious head injury and the man called 911. Police and EHS responded. A number of other people had gathered in the area, including the young boy’s grandparents. The scene was somewhat chaotic.
The three police vehicles and ambulance that arrived were parked on the street which was narrowed by large snow banks. Two police officers were in a police SUV speaking by phone with Community Services regarding possible issues related to the boy’s care at home. During the call the ambulance appeared to be backing up to take the boy to the hospital. The officer driving the SUV began to back up to allow the ambulance to leave more quickly. Unfortunately, the man who had called 911 was now standing behind the SUV, apparently helping with traffic. He was not seen by the driver. The SUV backed over him, and then went forward. In spite of immediate assistance provided by the EHS personnel, the male passed away at the scene.
The officer’s actions were at most a mistake caused by momentary inattention. His actions do not constitute a criminal offence and do not justify any charges under the Motor Vehicle Act. The family of the deceased male have indicated that they consider the incident to have been an accident.
