No Charges in Fall from Balcony
The province's independent Serious Incident Response Team (SiRT) released its report today regarding the investigation into a January 13, 2018 incident involving a man going over a third-floor balcony at an apartment on Evans Avenue in Halifax.
Halifax Regional Police were called to the apartment building as a result of a disturbance call in relation to a male who was not a tenant of the building. The male was the ex-boyfriend of a tenant in the building who was not home at the time. Police received permission to enter the apartment and remove the male. The male would not comply with the officers request to open the door so officers broke the chain lock and entered the apartment. When entry was made, the male had left the apartment via the balcony. Officers went out on the balcony and observed the male lying on the ground below with blood coming from his head. Officers provide medical assistance and called EHS.
The male received injuries to his head, neck and back. The male admitted later to the SiRT investigator that the police had nothing to do with his injuries. The male indicated he slipped as he was going over the balcony railing in an effort to avoid the police. The three responding officers cooperated with the SiRT investigation and admitted they had no contact with the male.
The male’s injuries occurred from his accidental fall off the balcony. His decision was made in an effort to evade the police and there was no interaction with any of the responding officers giving rise to any injury. Therefore, there are no grounds for any charges.
