Allegation of Improper Arrest made against Annapolis Royal Police

The province's independent Serious Incident Response Team (SiRT) has commenced an investigation regarding an allegation made by a Yarmouth man regarding what he states was inappropriate sexual touching during an arrest by members of the Annapolis Royal Police Department (ARPD) on July 9, 2015.

At approximately 4:00 p.m., police approached the man, seated in the driver’s seat of a black pickup truck, near the intersection of St. George and St. Anthony streets in Annapolis Royal. The police were investigating a driving complaint in relation to the truck. After some discussion, the police attempted to arrest the man. During the arrest a struggle ensued.  The man alleges that during the struggle his pants were ripped, his genitals were exposed, and he was inappropriately touched by an officer.

The man gave a statement about this matter to SiRT earlier this week.  The provisions of the Police Act mandate that SiRT is responsible for the investigation of any allegation of sexual assault made against a police officer.

It is believed there may have been several people in the area at the time. Anyone who may have witnessed the incident is asked to contact SiRT toll free at 1-855-450-2010.

The Serious Incident Response Team is responsible for investigating all serious incidents involving police in Nova Scotia, whether or not there is an allegation of wrongdoing. Investigations are under the direction and control of independent civilian director Ron MacDonald.

The team can independently begin an investigation after a referral from a chief of police, the head of the RCMP in Nova Scotia or the Minister of Justice. It can also investigate after a complaint from the public.

The Police Act requires the director to file a public report summarizing the result of the investigation within three months after it is finished.
